How to file your international application

You just need only 01 application for international trademark protection in more than 171 countries member of Madrid System 

Requirements:

  • Original application was filed in a member country of Madrid System.
  • The countries which you want to protect are member of Madrid system (check here)
  • You have a original application filed in a member country.

Application

You must send the Form MM2 to your local Office (Office of origin). Do not send it directly to WIPO. All international applications designating the United States of America must also include Form MM18 (Declaration of intention to use the mark).

You may use Madrid system to file your international trademark application if you meet these requirements:

  • Original application was filed in a member country of Madrid System.
  • You must file your international application in your IP office first (with Form MM2)
  • The countries which you want to protect are member of Madrid system (check here)
  • You want to protect in more than 03 countries (it’s not required, however we highly recommend)

The international trademark application (ITMA) must be submitted to your Office of origin, which will check that it corresponds with the particulars of your basic mark, certify the international application, and then submit it to WIPO.

First step: Check the classification of your goods/ services (click here)

Second Step: Filing your original application in your IP Office (a member of Madrid system)

Third Step: Filing your ITMA to WIPO. Please use Form MM2

Note: You must send the Form MM2 to your local Office (Office of origin). Do not send it directly to WIPO. All international applications designating the United States of America must also include Form MM18 (Declaration of intention to use the mark).

Fourth Step: Pay your fees (check your fees here)

Fifth Step: Received your International Application number and Office Action. 

– MM2: (Application for international registration governed exclusively by the Madrid Protocol)

– MM5: Request for the recordal of a Change in Ownership

– MM8: Request for the recordal of a Cancellation of the International Registration

– MM11: Renewal of the international registration

– MM13: Request for the Recording of a License
